RENTAL TERMS & CONDITIONS / B+ RENTAL AGREEMENT

1. Use of the Premises

The property is rented exclusively for residential use on a temporary basis. The tenant, prior to booking, declares that the reservation is unrelated to any professional activity. Therefore, if it turns out that the tenant carries out any professional activity on the premises, they shall not benefit from any special legal rights related to such use. No commercial, craft, or professional activity is permitted. The apartment may not serve as the tenant’s primary or secondary residence. As a result, the tenant cannot claim any legal rights typically applicable to residential leases, particularly regarding rights to remain in the premises.

2. Upon Arrival

Check-in is from 4:00 PM.
Check-out is before 10:00 AM on weekdays and before 11:00 AM on weekends.
We will be there to welcome you at the specified address or will provide instructions for self check-in. Please inform us of your estimated arrival time as early as possible.

3. Condition of the Property

In addition to the inventory, a condition report (check-in/check-out) is drawn up in two copies, one for each party, and attached to this contract.
If no such report is completed, the tenant is presumed to have received the premises in good condition for rental use, and must return them as such, unless proven otherwise (Article 1731 of the Civil Code).

4. Rental Duration

The rental period is as specified at the time of booking.
The contract automatically ends at the end of this defined period.
No extension of the stay is permitted without the prior and express consent of La Boite en Plus.

5. Rent

The full rent is due upon arrival, and 100% is charged at the time of booking.
Please note: a security deposit of €300 or €500 may be blocked (but not charged) on your bank account for 20 days (for direct bookings and Booking.com), to ensure the property is returned in good condition.

6. Obligations of the Parties

a. The Owner agrees to:

  • Provide a property in good working order with all listed furniture and equipment functional;

  • Deliver the services specified in the contract;

  • Maintain the property in a condition suitable for its intended use and make all necessary repairs.

b. The Tenant agrees to:

  • Pay the rent as agreed;

  • Comply with key handover and return procedures;

  • Use the property peacefully in accordance with its intended purpose;

  • Not assign or sublet the premises, even for free;

  • Be present in the apartment unless otherwise agreed at booking;

  • Lock the entrance and common doors – the tenant is liable in case of theft;

  • Complete the guest app and provide ID for all guests;

  • Be responsible for any damage or loss during the stay, except in cases of force majeure, landlord fault, or third-party intrusion;

  • Avoid disposing of any materials that may clog drains – any restoration costs will be charged to the tenant;

  • Not alter the property or its equipment;

  • Clean the kitchen/kitchenette and dishes before departure and leave the property clean and free of trash or clutter. Furniture must be returned to its original place;

  • Comply with building and co-ownership rules;

  • Have insurance coverage (rental risks, theft, fire, water damage, and third-party liability) and provide proof upon key collection. La Boite en Plus accepts no liability if the tenant is uninsured;

  • Not use paid video-on-demand services via the television.

7. Liability

The tenant waives any claims against La Boite en Plus in the following cases:

  1. Theft, attempted theft, or any unlawful act occurring in the premises;

  2. Malfunction or interruption of utilities (elevators, water, electricity, gas, phone, internet, A/C, etc.);

  3. Noise or disturbance (e.g. construction) originating outside the apartment;

  4. Accidents occurring in or due to the apartment during the rental period;

  5. Internet or TV malfunctions or incompatibility with tenant’s devices;

  6. Non-compliance with parking regulations, or towing/fines resulting from exceptional events;

  7. Change of apartment if required by circumstances – La Boite en Plus accepts no responsibility for the content accessed by the tenant on the internet.

8. Stay Cancellation

a. By the Tenant:

If the refundable option was selected, cancellation is possible by email at least 24 hours before the stay’s start. In this case, a full refund will be issued.
If cancelled after the stay begins, no refund will be made.
If the non-refundable option was chosen, the full reservation amount remains due regardless of cancellation.

These conditions only apply to direct bookings via our website. Reservations made through OTAs (Airbnb, Booking, Abritel, etc.) are subject to their own cancellation policies.

b. By the Owner:

La Boite en Plus reserves the right to cancel the stay at any time. If so, an equivalent alternative apartment may be offered.
If no alternative is available or acceptable to the tenant, the reservation will be fully refunded. No further claims may be made against La Boite en Plus.

9. Termination and Penalty Clauses

a. Termination Clause:

If the amounts due under Article 1.3 are not paid, the contract will be automatically terminated, without judicial formalities.

b. Penalty Clause:

In accordance with Article 1226 of the Civil Code, in addition to possible termination and damages, a late payment will incur a 15% penalty on the amount due. This penalty applies if the tenant fails to act within seven days following a formal notice sent by registered letter with acknowledgment of receipt.
